You must attend all required government interviews, visa appointments, and meetings, responding promptly to any requests.
You must provide truthful, accurate, and complete information throughout the entire process. Any misrepresentation, omission, or failure to disclose material information will void the Money-Back Guarantee.
All fees and expenses owed to Abachi Law must have been paid in full and kept current.
Abachi Law must represent you for any Requests for Evidence (RFEs), Notices of Intent to Deny (NOIDs), or similar government requests.
You must follow all legal advice provided by Abachi Law regarding your case. Failure to do so may void the Money-Back Guarantee.
Participation in the Money-Back Guarantee is contingent upon payment of an opt-in fee and approval by our team after a detailed review of your case. This fee is non-refundable once the petition is approved, and opting into this guarantee does not ensure acceptance into the program, as each case is evaluated individually.
You must not have any grounds of inadmissibility under U.S. immigration laws that could prevent visa approval. This includes: No Prior Denials: You have never been denied entry to the U.S., or a visa or immigration benefit. No Criminal History: You have no criminal charges, arrests, or convictions in any country. No Immigration Violations: You have not violated U.S. immigration laws, including overstaying a visa or unauthorized employment.
All material facts related to your case must be disclosed in writing to Abachi Law.
If your case is denied, you may choose to have Abachi Law refile your case one time at no additional legal cost instead of opting for a refund. Refiling can offer advantages, such as incorporating new achievements or qualifications that strengthen your case.

Choosing to refile waives your right to request a refund under the Money-Back Guarantee.
You are responsible for all government filing fees, translation services, postage, and other non-legal expenses associated with refiling.
The Money-Back Guarantee covers only one refiling attempt. Subsequent refilings will require a new engagement agreement.
Abachi Law reserves the right to decline a refiling request if, in good faith, there is no reasonable basis for refiling. In such cases, you will be entitled to a refund as per the Money-Back Guarantee terms.

Submit your refund request within 30 calendar days of the date on the U.S. government's denial notice.

Provide a copy of the denial letter and any other relevant documentation as requested in the form.
Abachi Law will review your refund request to confirm eligibility under the guarantee terms. This review may take up to 30 business days from the date of your submission.
Refunds will be issued via the original payment method or as agreed, within 30 business days after approval of your refund request. Additional banking processing times of 3-10 business days may apply, depending on your financial institution.
Refunds are issued in full for legal fees paid; partial refunds are not available under this guarantee.
This guarantee applies exclusively to the approval of the petition at the USCIS level. It does not extend to consular processing or the issuance of the visa itself after the petition has been approved. Please be aware that no individual or firm can guarantee the outcome of consular processing, as it is subject to additional reviews and discretionary decisions by consular officers.

The guarantee is not an admission of liability by Abachi Law or its co-counsel. Abachi Law's liability is limited to the legal fees paid under the Money-Back Guarantee. We are not liable for consequential damages, lost opportunities, or other issues arising from your case's denial.
Refunds under the Money-Back Guarantee apply to the total legal fee paid, including the opt-in fee, provided all eligibility requirements and terms have been met. If the application is approved, no portion of the legal fee or opt-in fee is refundable under any circumstances.
Abachi Law reserves the right to terminate representation if you are untruthful, uncooperative, or breach any terms of our agreement. Such termination voids eligibility for the Money-Back Guarantee.
Abachi Law shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, government actions, or changes in law.
This Money-Back Guarantee and any disputes arising from it are governed by the laws of New Jersey. Any disputes shall be resolved through binding arbitration in New Jersey, in accordance with the rules of the American Arbitration Association.
