Privacy Policy and SMS Terms of Service
Effective Date: December 8, 2024
Abachi Law LLC (“Abachi Law,” “we,” “us,” or “our”) values your trust and respects your privacy. This Privacy Policy explains how we collect, use, disclose, transfer, and protect personal information obtained through our website, client intake and scheduling pages, SMS messaging services, and related online platforms (collectively, the “Services”). It also explains your choices and rights with respect to that information. By using the Services—whether by visiting our website, submitting an inquiry, opting into SMS messaging, or engaging us for legal services—you acknowledge and agree to this Privacy Policy, including the SMS program terms set out below.
About Abachi Law and Scope
Abachi Law is a U.S.-based law firm serving domestic and international clients, with particular focus on immigration and entertainment matters, including O, P, EB-1, and EB-2/NIW petitions, related filings, and select entertainment law services. This Privacy Policy applies to personal information collected through the Services and does not apply to data collected and used in the context of attorney employment, or to information processed within our client-use-only secure portal after you become a client, which is governed by matter-specific confidentiality obligations, applicable professional responsibility rules, and any separate terms we may provide.
Definition of Personal Information
For purposes of this Privacy Policy, “personal information” means information from or about an individual that identifies that individual directly, or that reasonably can be used to identify the individual when combined with other information. Personal information does not include aggregated, de-identified, or anonymized data that cannot reasonably be linked to an identifiable person.
Information We Collect
We collect personal information that you provide voluntarily, such as when you submit a contact form, request a consultation, communicate with us by phone, email, or text, schedule an appointment, or engage our legal services. This may include your name, email address, telephone number, mailing address, business affiliation and title, matter details and documents relevant to your legal inquiry, payment information for billing, and your communications preferences, including your choice to receive SMS text messages. When you opt in to SMS communications, we collect your mobile telephone number and record your consent.
When you visit our website, we also collect certain information automatically, including device identifiers, IP address, browser type, operating system, pages visited, referring URLs, and interaction data. We use cookies and similar technologies to recognize returning devices, understand site usage, maintain security, and improve user experience. You may disable cookies in your browser; however, some features of the Services may not function properly if cookies are disabled.
Analytics
We use Google Analytics and Siteimprove to measure and analyze traffic and usage patterns. These services use cookies. We have enabled IP anonymization so that only truncated IP addresses are processed for analytics. The resulting reports help us maintain and improve the Services. We do not use analytics for behavioral advertising, nor do we sell analytics data.
How We Use Personal Information
We use personal information to communicate with you; evaluate and respond to inquiries; provide, manage, and improve our legal services; send operational notices, including appointment confirmations, case status updates, document requests, and billing notifications; process invoices and payments; maintain the security and integrity of our systems; comply with legal and ethical obligations; and perform other functions consistent with this Privacy Policy and applicable law.
SMS Messaging Program (Opt-In, Content, Frequency, Fees, Help/Stop)
Abachi Law offers an optional SMS messaging program for clients and prospective clients who wish to receive timely, informational text messages, such as consultation confirmations, appointment reminders, case status updates, document submission alerts, and billing or account notifications. Participation is voluntary and not a condition of purchase or engagement. You may opt in through a website form, consultation scheduling page, or during the intake process by expressly consenting to receive text messages at the number you provide. By opting in, you agree to receive messages as described in this Privacy Policy. Message frequency may vary based on your matter and engagement activity. Message and data rates may apply. You may opt out at any time by replying “STOP” to any message; you will receive a final message confirming your opt-out. For assistance, reply “HELP,” email info@abachilaw.com, or call (718) 540-7375. SMS consent is not shared with third parties or affiliates. We use SMS solely for operational and account-related communications; we do not use SMS for marketing.
Disclosure of Personal Information
We do not sell or rent personal information. We disclose personal information only as necessary to provide the Services and operate our practice, including to service providers that perform functions on our behalf—such as secure hosting, client communications, analytics, e-signature, document management, and payment processing—subject to confidentiality and data protection obligations. We also may disclose information to comply with law, court orders, or regulatory requirements; to protect our rights, clients, and systems; or in connection with a business reorganization that does not diminish the protections described in this Privacy Policy.
International Transfers
Personal information collected through the Services may be transferred to, stored in, and processed on servers located in the United States. By providing information to us, you acknowledge such transfer in accordance with applicable law. Where required, we take appropriate measures to ensure a level of protection for personal information that is consistent with this Privacy Policy and applicable legal standards.
Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against accidental, unlawful, or unauthorized access, destruction, loss, alteration, disclosure, or use. No method of transmission or storage is entirely secure; however, we apply commercially reasonable measures and legal-industry practices to protect personal information entrusted to us.
Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with legal and ethical obligations (including records-retention rules applicable to law practices), to resolve disputes, and to enforce our agreements. We may retain de-identified or aggregated data for analytics, quality assurance, and business continuity.
Your Choices and Rights
You may update your contact information or communications preferences by contacting us. You may opt out of SMS at any time by replying “STOP” to any message, and you may obtain assistance by replying “HELP,” emailing info@abachilaw.com, or calling (718) 540-7375. Subject to legal and professional obligations, you may request access to, correction of, or deletion of personal information that we maintain about you. We will respond in accordance with applicable law and professional rules.
Children’s Privacy
Our Services are not directed to children under 13 years of age, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so that we may take appropriate action.
