This Money-Back Guarantee is not offered from the outset of a case. Whether it can be offered depends on the final record available when the petition is ready to file. If, after reviewing the final filing record, Abachi Law agrees to offer the Money-Back Guarantee and you choose to opt in, a separate non-refundable add-on fee stated in the Matter Schedule and separate written terms must be completed before filing.
The Money-Back Guarantee is not a promise of approval, visa issuance, admission to the United States, adjustment of status, or any other immigration benefit. It applies only to the USCIS petition decision on the covered filing.

Eligibility for Our Money-Back Guarantee
To qualify for any remedy under our Money-Back Guarantee, you must meet all of the following conditions.

Covered Petition Types
The Money-Back Guarantee may apply only to selected talent-based visa petitions prepared and filed by Abachi Law, including O, P, and EB petitions. It applies only if the specific petition is identified as covered in the signed Matter Schedule or separate written Money-Back Guarantee terms.

USCIS Petition Decision Only
The Money-Back Guarantee covers only the USCIS decision on the covered petition. It does not cover consular processing, visa issuance, NVC processing, adjustment of status, employment authorization, advance parole, CBP admission, or any other step outside the USCIS petition decision.

Final Pre-Filing Review Required
Abachi Law determines Money-Back Guarantee eligibility only after reviewing the final record that is ready for filing. The Firm may decline to offer the Money-Back Guarantee for any case, even if the case may otherwise be viable or strong.

Written Approval and Opt-In Fee Requirement
No Money-Back Guarantee exists unless Abachi Law approves it in writing before filing, you sign the separate written Money-Back Guarantee terms or Matter Schedule, and you pay the separate non-refundable add-on fee stated in the Matter Schedule.

Opt-In Fee and Approval Requirement
Participation in the Money-Back Guarantee is contingent upon payment of an opt-in fee and approval by our team after a detailed review of your case. This fee is non-refundable once the petition is approved, and opting into this guarantee does not ensure acceptance into the program, as each case is evaluated individually.

Provide Accurate and Complete Information
You must provide truthful, accurate, complete, and timely information throughout the entire process. Any fraud, misrepresentation, omission, inaccurate statement, or failure to disclose material information will void the Money-Back Guarantee.

Attend All Required Appointments
You must attend all required government interviews, visa appointments, and meetings, responding promptly to any requests.

Provide Accurate and Complete Information
You must provide truthful, accurate, and complete information throughout the entire process. Any misrepresentation, omission, or failure to disclose material information will void the Money-Back Guarantee.

Current Fee Status
All legal fees, Money-Back Guarantee fees, government filing fees, consultation letter fees, expert fees, translation costs, mailing costs, and other expenses owed or required for the case must be paid in full and kept current.

Counsel Representation for Government Requests
Abachi Law must represent you for any Requests for Evidence, Notices of Intent to Deny, or similar government requests on the covered petition. If you refuse to respond, instruct the Firm not to respond, change counsel, proceed without counsel, or otherwise prevent Abachi Law from handling the response, the Money-Back Guarantee may be void.

Compliance with Legal Advice
You must follow all legal advice, filing strategy, document instructions, and risk guidance provided by Abachi Law regarding the covered petition. Failure to do so may void the Money-Back Guarantee.

No Disqualifying Facts Outside the Petition Merits
The Money-Back Guarantee may be void if the denial or adverse action results from facts outside the merits of the petition. This includes criminal history, arrests, charges, convictions, immigration violations, unauthorized employment, status violations, prior fraud findings, inadmissibility issues, security concerns, sanctions issues, or other facts outside Abachi Law’s control.

Full Disclosure of Material Facts
All material facts related to your case must be disclosed in writing to Abachi Law. This includes prior denials, prior visa refusals, prior immigration violations, prior unauthorized employment, criminal issues, immigration history problems, status issues, and any fact that may affect petition strategy or government review.

Refiling Option Instead of Refund
If USCIS issues a final written denial of the covered petition and all Money-Back Guarantee terms are satisfied, you may choose to have Abachi Law refile the same petition type one time at no additional legal fee instead of opting for a refund. You may not receive both remedies.
Refiling may allow the case to be reorganized, supplemented, or strengthened, but it is not a promise of approval.

Election of Refiling
Choosing to refile waives your right to request a refund under the Money-Back Guarantee for the denied filing.

Client Responsibility for Costs
You are responsible for all government filing fees, premium processing fees, consultation letter fees, expert fees, translation costs, postage, mailing costs, platform fees, and other non-legal expenses associated with refiling.

Limit on Refiling
The Money-Back Guarantee covers only one refiling attempt at no additional legal fee. Subsequent refilings will require a new engagement agreement and new legal fee unless otherwise agreed in writing.

Firm's Right to Decline
Abachi Law reserves the right to decline a refiling request if, in good faith, there is no reasonable legal or factual basis for refiling. In such cases, if all Money-Back Guarantee terms are otherwise satisfied, you will be entitled to the refund remedy described in the written Money-Back Guarantee terms.

Refund Procedure
To initiate a refund under our Money-Back Guarantee, please follow these steps.

Request Timeline
Submit your refund request within 30 calendar days of the date on USCIS’s final written denial notice for the covered petition.

Submit the Refund Request by Email
Provide all requested information so Abachi Law can review eligibility under the written Money-Back Guarantee terms.

Documentation Requirement
Provide a copy of the USCIS denial notice, USCIS receipt notice, and any other relevant documentation requested in the form or by Abachi Law.

Review Process
Abachi Law will review your refund request to confirm eligibility under the guarantee terms. This review may take up to 30 business days from the date of your complete submission.

Refund Method
If the refund request is approved, refunds will be issued via the original payment method or as agreed, within 30 business days after approval of your refund request. Additional banking processing times of 3 to 10 business days may apply, depending on your financial institution.

No Refund of MBG Fee or Third-Party Costs
Refunds apply only to the base legal fee actually paid to Abachi Law for the covered petition. The Money-Back Guarantee add-on fee is non-refundable. Government filing fees, premium processing fees, consultation letter fees, expert fees, translation costs, mailing costs, bank fees, platform fees, and other third-party costs are not refundable by Abachi Law.
This guarantee applies exclusively to the USCIS petition decision for the covered filing. It does not extend to consular processing, visa issuance, NVC processing, adjustment of status, employment authorization, advance parole, CBP admission, or any other immigration benefit.
If a petition requested for change of status is approved for consular notification, that is an approval for Money-Back Guarantee purposes.
No individual or firm can guarantee visa issuance, consular processing, adjustment of status, admission, or any other government outcome outside the covered USCIS petition decision.

Please note the following important terms and conditions applicable to our Money-Back Guarantee
The Money-Back Guarantee does not constitute a guarantee of petition approval, visa approval, admission to the United States, change of status, adjustment of status, employment authorization, or any other immigration benefit. It does not imply any specific likelihood of success.
The Money-Back Guarantee is limited solely to the USCIS petition decision for the covered filing. It does not cover subsequent or separate stages, including consular processing, visa issuance, administrative processing, NVC processing, adjustment of status, employment authorization, advance parole, or CBP admission. Outcomes at these stages are outside the scope of the Money-Back Guarantee.
External factors such as changes in immigration law, regulations, USCIS policy, agency interpretation, filing procedures, filing fees, premium processing rules, evidentiary standards, government operations, Department of State policy, or unforeseen events may affect your case’s processing and outcome. These factors are beyond Abachi Law’s control and may void the Money-Back Guarantee if they materially affect the covered petition or the Firm’s initial eligibility evaluation.
The guarantee is not an admission of liability by Abachi Law or its co-counsel. Abachi Law’s liability is limited to the remedy stated in the written Money-Back Guarantee terms. We are not liable for consequential damages, lost opportunities, lost income, travel costs, business losses, delay damages, or other issues arising from a denial, delay, government action, or case outcome.
Refunds under the Money-Back Guarantee apply only to the base legal fee actually paid to Abachi Law for the covered petition, provided all eligibility requirements and terms have been met. The Money-Back Guarantee add-on fee is non-refundable. Government filing fees, premium processing fees, consultation letter fees, expert fees, translation costs, mailing costs, bank fees, platform fees, and other third-party costs are not refundable by Abachi Law. If the covered petition is approved, no refund is available.
Abachi Law reserves the right to terminate representation if you are untruthful, uncooperative, fail to pay required fees or costs, fail to provide required documents or signatures, refuse to follow legal advice, or breach any terms of our agreement. Such termination voids eligibility for the Money-Back Guarantee.
Abachi Law shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, public emergency, government shutdown, court order, agency suspension of services, mail disruption, technology outage, payment processing failure, or changes in law, policy, or government procedure.
This Money-Back Guarantee and any disputes arising from it are governed by the laws of New Jersey, except where federal law controls. Any dispute resolution provision in the signed engagement agreement, Matter Schedule, or separate Money-Back Guarantee terms controls.
The Money-Back Guarantee is triggered only by a final written USCIS denial of the covered petition.
A rejected filing, Request for Evidence, Notice of Intent to Deny, withdrawal, abandonment, revocation after approval, shorter approval period, consular refusal, visa refusal, administrative processing, adjustment of status denial, NVC issue, CBP issue, or delay does not trigger the Money-Back Guarantee.
An approval for consular notification counts as an approval even if the petition requested change of status.
If the same petition is later approved through any later action, including a motion, appeal, reopened proceeding, reconsideration, remand, federal court action, agency action, action by Abachi Law, action by another attorney, or pro se action by the client, then no refund is owed.
If Abachi Law already issued a refund and the same petition is later approved, the client must repay the refunded legal fee to Abachi Law within ten business days of approval.
If USCIS denies the covered petition, Abachi Law may determine that a motion, appeal, or federal action is legally colorable. If so, Abachi Law may offer a separate paid engagement for that work.
The client remains free to accept, decline, proceed without counsel, or retain other counsel.
The Money-Back Guarantee does not include motion, appeal, or federal litigation work unless separately agreed in writing.
The signed engagement agreement, Matter Schedule, and separate written Money-Back Guarantee terms control the parties’ rights and obligations.
